JAPA GENIE – TERMS & CONDITIONS

1. DEFINITIONS

1.1 “Japa Genie”, “we”, “us” or “our” means Japa Genie Inc., a corporation incorporated under the Canada Business Corporations Act, with its head office at [Address, City, Province].

1.2 “Service” means our AI-powered visa guidance and mock-interview web app available at https://japa-genie-test-v1-preauth.vercel.app/ (or any successor URL).

1.3 “Personal Information” has the meaning set out in the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws.

2. ACCEPTANCE

By clicking “Start Your Journey”, creating an account, or making a payment, you agree to these Terms and our Privacy Policy (together, the “Agreement”). If you do not agree, do not use the Service.

3. ELIGIBILITY & CAPACITY

You must be at least 16 years old and capable of entering a legally binding contract in your jurisdiction.

4. SERVICE DESCRIPTION & DISCLAIMERS

4.1 Japa Genie provides algorithmic recommendations, checklists, and AI-generated mock interviews to help users prepare for visa applications.

4.2 We are not a law firm, immigration consultant (RCIC), paralegal, or government agency. Nothing provided constitutes legal advice or guarantees visa approval.

4.3 Immigration authorities make independent decisions. Japa Genie does not influence or guarantee outcomes.

5. ACCOUNT SECURITY

You are responsible for keeping your login credentials secure. Notify us immediately at admin@japagenie.com if you suspect unauthorized access.

6. USER CONTENT & LICENCE

6.1 “User Content” means any data or file you upload.

6.2 You retain ownership but grant us a limited licence to host, copy, and process the content solely to operate and improve the Service.

6.3 You confirm you have all rights to your content and that it does not violate any law or third-party rights.

7. PRIVACY & PERSONAL INFORMATION

7.1 We collect and handle Personal Information in accordance with PIPEDA, and our Privacy Policy.

7.2 We will obtain opt-in consent before using sensitive information (e.g., passport numbers, biometrics).

8. FEES, BILLING & REFUNDS

8.1 Premium features and consultations are billed in Canadian dollars (CAD) and exclude applicable GST/HST/QST.

8.2 You may cancel your subscription or auto-renewal at any time via your Billing page.

8.3 Refund Policy:

  • (a) Users in Québec and Ontario may cancel within 7 days of purchase for a pro-rata refund of unused full months.
  • (b) Outside those provinces, refunds are discretionary and will only be granted where required by consumer law.
  • (c) Services already accessed, downloaded, or substantially used (e.g., AI-generated visa roadmap, mock interviews, or recommendations) are considered rendered and non-refundable.
  • (d) If you file a chargeback after using the Service, Japa Genie reserves the right to provide evidence of use to the payment processor and to suspend your account pending resolution.

9. FAIR USE & PROHIBITED CONDUCT

You agree not to:

  • Scrape, data-mine, or reverse-engineer the Service;
  • Submit forged or false documents;
  • Share your account;
  • Use the Service for illegal, abusive, or fraudulent purposes.

Violations may result in termination without refund.

10. INTELLECTUAL PROPERTY

All AI models, software, and branding belong to Japa Genie Inc. or its licensors. You are granted only a limited, non-transferable right to access the Service.
